Terms of Service

Please read these terms carefully before using our website and services.

Effective Date: March 26, 2026

These Terms of Service ("Terms") govern your use of the website and services provided by Functional Life Achievement, Inc. ("FLA," "we," "our," or "us"), a 501(c)(3) non-profit organization providing Early Intervention Program (EIP) services in New York City. By accessing our website or using our services, you agree to these Terms.

1. About Our Services

Functional Life Achievement provides Early Intervention services for children from birth to age three (0-3) who have developmental delays or disabilities, as authorized under the New York State Early Intervention Program (Title II-A of Article 25 of the Public Health Law). Our services include but are not limited to:

  • Multidisciplinary evaluations and psychological assessments
  • Speech and language pathology
  • Occupational therapy (OT)
  • Physical therapy (PT)
  • Special education / special instruction
  • Applied Behavior Analysis (ABA)
  • Social work services
  • Service coordination

All services are provided in accordance with each child's Individualized Family Service Plan (IFSP) as developed through the NYC Early Intervention Program and authorized by the Early Intervention Official Designee (EIOD).

2. Eligibility

Early Intervention services through FLA are available to children who:

  • Are under three (3) years of age
  • Reside in New York City
  • Have been referred to the NYC Early Intervention Program
  • Have been evaluated and found eligible based on a confirmed developmental delay or diagnosed condition as defined by NYS regulations

Services are provided at no cost to families. The Early Intervention Program is funded by the New York State Department of Health and administered locally by the NYC Department of Health and Mental Hygiene (DOHMH).

3. Use of Our Website

Our website is provided for informational purposes and to facilitate communication with families, referral sources, and our staff. By using our website, you agree to:

  • Provide accurate and complete information when submitting forms
  • Use the website only for lawful purposes
  • Not attempt to interfere with the proper functioning of the website
  • Not upload malicious content or attempt unauthorized access to our systems

4. Referral Submissions

Referrals submitted through our website are forwarded to the NYC Early Intervention Program for processing. Submission of a referral does not guarantee eligibility for services. All referrals are subject to the standard EIP evaluation and eligibility process as governed by NYS Public Health Law and NYSDOH regulations.

Primary referral sources include parents, physicians, hospitals, childcare providers, and other professionals who have concerns about a child's development.

5. Therapist Uploader Portal

The Therapist Uploader portal is restricted to authorized FLA staff and contracted therapists. By using the portal, authorized users agree to:

  • Submit only accurate and complete documentation
  • Maintain the confidentiality of all client information
  • Comply with HIPAA and all applicable privacy regulations
  • Not share login credentials with unauthorized individuals

Misuse of the portal may result in suspension of access and disciplinary action.

6. Consent and Authorization

All Early Intervention services require written parental consent. Parents and guardians have the right to:

  • Consent to or decline any proposed evaluation or service
  • Participate in the development and review of their child's IFSP
  • Request changes to services at any time
  • Access their child's records
  • File a complaint or request mediation through the NYS Bureau of Early Intervention

7. Intellectual Property

All content on the FLA website, including text, graphics, logos, images, and design elements, is the property of Functional Life Achievement, Inc. and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission, except for personal, non-commercial use related to accessing our services.

8. Disclaimer of Warranties

The information on our website is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult with a qualified healthcare professional regarding your child's specific needs.

While we strive to keep our website accurate and up to date, we make no warranties or representations about the completeness, reliability, or accuracy of the information provided. Our website is provided on an "as is" basis.

9. Limitation of Liability

To the fullest extent permitted by law, Functional Life Achievement shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. This limitation does not apply to claims arising from our provision of Early Intervention services, which are governed by applicable federal and state law.

10. Third-Party Services

Our website may integrate with or link to third-party services, including:

  • JotForm for contact, referral, and document upload forms
  • Google Maps for location information
  • Google Fonts for website typography

These services are governed by their own terms and privacy policies. FLA is not responsible for the practices of third-party providers.

11. Compliance

FLA operates in compliance with all applicable laws and regulations, including:

  • New York State Public Health Law, Title II-A of Article 25 (Early Intervention Program)
  • NYSDOH Bureau of Early Intervention regulations (10 NYCRR Subpart 69-4)
  • Health Insurance Portability and Accountability Act (HIPAA)
  • Family Educational Rights and Privacy Act (FERPA)
  • Americans with Disabilities Act (ADA)
  • Section 504 of the Rehabilitation Act
  • Title VI of the Civil Rights Act (language access and non-discrimination)

12. Non-Discrimination

Functional Life Achievement does not discriminate on the basis of race, color, national origin, sex, age, disability, religion, sexual orientation, gender identity, or any other characteristic protected by federal, state, or local law. We are committed to providing culturally and linguistically appropriate services to all families.

13. Grievance and Dispute Resolution

If you have a concern about the services provided by FLA, we encourage you to contact us directly. You also have the right to:

  • File a complaint with the NYC Bureau of Early Intervention
  • Request mediation through the NYS Department of Health
  • Request an impartial hearing to resolve disputes regarding your child's evaluation, IFSP, or services

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
